Internet gambling changes possible following Australian Productivity Commission report - 26th October 2009

SYDNEY, Australia - A new approach to tackling gambling could see the Australian government place a $1 per bet limit on pokie machines and repeal the ban on Australian online gaming sites, News Limited reports.

The 630 page draft report of the year-long review appears to be a government initiative to help make gambling safer through harm minimization strategies.

The report, quoted in The Courier Mail, acknowledges "Australia's ban on online gaming is not working, with Australians increasingly gambling abroad on sites with minimal consumer protection."

The final report carried out by the Productivity Commission is due for release on 26th February at this stage.

Anurag Dikshit’s Sale of Party Gaming Stock Receives Mixed Reaction, by Dan Cypra - 25th October 2009

One of the major poker headlines this week was the news that Party Gaming Cofounder Anurag Dikshit would divest himself of nearly 114 million shares of the company’s stock, which is traded in London under the symbol “PRTY.” Now, the industry has had a chance to react.

The internet gambling think tank sported mixed reactions to the news, as Dikshit’s departure meant that a man who admitted to violating U.S. law in a New York courtroom one year ago would no longer hold any interest in the company. Interactive Media Entertainment and Gaming Association (iMEGA) Chairman Joe Brennan told Poker News Daily, “The thing to take away is that this is probably good overall for Party Gaming. When you have one of their founders pleading guilty, if and when things start to get normalized in the U.S. and Party Gaming comes into the market, they need to clear it off the books. The fact that he’s exiting the company is good for its future.”

When internet gambling will be legalized and regulated in the United States is anyone’s guess. Congressman Barney Frank (D-MA) introduced HR 2267 in May as one solution. The bill outlines a framework for the explicit legalization of the industry and, although the measure is up to 62 cosponsors, it has not yet been scheduled for markup in the House Financial Services Committee.

On how members of Congress and others outside of the industry would react to Dikshit’s exit, Brennan explained, “If Dikshit leaving Party Gaming can be a benefit to that company, I would say that it does the same broadly for the industry.” Financial analyst Nick Batram told Bloomberg that Dikshit’s departure meant that Party Gaming “may also find it easier to raise funds from institutional investors rather than the founders for large sports gambling acquisitions.” The Wire Act of 1961 has historically been interpreted to mean that online wagering on sports is not permitted in the U.S.

Dikshit will purportedly turn over the proceeds of his sale, which will likely total more than ₤188 million, to his charitable foundation. On the TwoPlusTwo online poker forums, posters questioned Dikshit’s charitable motives: “If he donated to an established charity that could not be mistaken for a front, then that would be impressive,” one skeptic noted. Some have speculated that tax benefits are the real reason behind his actions. Brennan told Poker News Daily, “He wants to get out of the business and focus on his charitable endeavors.”

The sale of two-thirds of Dikshit’s stake sent shares of Party Gaming plummeting. Trading above 284 pence on October 19th, the stock dove to 240 pence in 24 hours, a dip of 15%. PRTY closed trading on Friday on the London Stock Exchange fetching 243 pence, 135 pence above its asking price one year ago.

The impact of the December 1st deadline remains to be seen, but the Poker Players Alliance (PPA) recently authored a letter to U.S. Treasury Secretary Timothy Geithner and Federal Reserve Chairman Ben Bernanke asking for the UIGEA’s regulations to be delayed by one year.

PartyGaming Co - Founder Sells Shares - 20th October 2009

LONDON (Reuters) - PartyGaming's billionaire co-founder Anurag Dikshit sold two thirds of his 28 percent stake in the world's biggest online gaming firm, raising 187.5 million pounds but knocking the shares.

Dikshit, who was fined $300 million after pleading guilty last December to an online betting charge in the United States, said in a statement on Tuesday he sold 75 million shares or about 18 percent of the company, at a price of 250 pence per share.

That was a 12 percent discount to Monday's closing price and was at the lower end of the 250-260 pence price range analysts had expected.

Shares in the company, which have more than doubled in value over the last twelve months, were down 12.6 percent to 248.8 pence at 1220 GMT (1:20 p.m. British time).

Analysts said the sale should be positive for PartyGaming in the long-term as it increases the level of institutional investment in the stock and makes a re-entry into the U.S. more feasible.

"He (Dikshit) has clearly decided to use the strong recent run to partially cash in and we would advise buying on today's drop, with the shares benefitting from an increased free float," said Daniel Stewart analyst James Hollins.

Prior to the sale, PartyGaming had a free float of less than 45 percent as co-founders Russell and Ruth DeLeon have also retained a 28 percent stake.

Davy Stockbrokers analyst David Jennings said Dikshit could now look to sell off the remainder of the stake or put it in a trust for his charitable foundation, improving the company's chances of returning to the U.S. should the current laws change.

"Under current U.S. law operators are unlikely to get licenses if any of their beneficial owners have criminal records. If they're going to win a licence he is going to have to sell down his stake," he said, Jennings said.

PartyGaming itself reached an agreement in April with U.S. authorities which will protect it from prosecution. The disputes arose after the industry was outlawed by legislation introduced in the U.S. in 2006.

Dikshit, co-founded PartyGaming in 1997 and was the driving force behind its user-friendly technology, which helped the company take a place in the FTSE 100 following a flotation on the London Stock Exchange in 2005.

PartyGaming enjoys strong start to Q4 - 15th October 2009

Online gambling firm PartyGaming (PRTY.L) said on Thursday it was confident about its full-year prospects, having made a strong start to the fourth quarter.

PartyGaming said its total revenue rose 11 percent to $112.7 million (69 million pounds) in the third quarter from the previous quarter, despite it normally being a weak period for the industry as players take their summer holidays.

Casino revenue climbed 2 percent to $49.2 million.

In Poker, where the company has faced increasing competition from unregulated United States operators such as PokerStars and Full Tilt, revenue fell 8 percent to $45.1 million.

However, Chief Executive Jim Ryan said the company had attracted new poker players through the launch of a number of initiatives including a loyalty programme and "VIP" offer.

"Poker remains challenging from a competitive standpoint, but we are encouraged by the increased player traffic during September and into October," he said.

Shares in PartyGaming, which have outperformed the FTSE All Share Leisure & Travel Index <.FTASX5750> by 15 percent since the start of the year, had fallen 0.4 percent to 281.5 pence at 9:00 a.m. British time.

KBC Peel Hunt analyst Nick Batram reiterated his 'hold' recommendation and 257 pence price target on the stock.

"The group's investment in poker is beginning to deliver some forward momentum, in player numbers and gross revenues at least. However, at this stage we continue to believe that the rating is up with events," he said.

The consensus for full-year pretax profit stands at $102 million, according to a Thomson Reuters I/B/E/S poll of ten analysts.

Party Gaming Revenue Down 4% in Q3 2009, by Tom Jenkins - 16th October 2009

In figures recently released by Party Gaming, the parent company of PartyPoker, revenues were off 4% in Q3 2009 compared to Q2. Company officials noted that the decrease was “in line with the normal seasonal pattern seen in previous years.”

The acquisition of Cashcade actually ballooned Party Gaming’s revenue to $112.7 million during the third quarter, up 11% from Q2. However, removing Cashcade’s impact meant that revenues decreased 4%. PartyPoker revenues were $45.1 million during the most recent three-month period, a slide of 8% versus Q2. Party Gaming management attributed the fall to “higher player numbers offset by lower yields.” The $45.1 million in poker revenue represented a significant dip from the $65.0 million reported in Q3 2008.

PartyCasino’s revenue clocked in at $49.2 million, up 2% from the previous quarter, and the company’s sports book revenue registered at $4.2 million, up 31%. The company reported Bingo revenues of $13.8 million, nearly seven times the total accrued by the division during the same period last year. Party Gaming CEO Jim Ryan commented in the company’s release to the London Stock Exchange, “Poker remains challenging from a competitive standpoint, but we are encouraged by the increased player traffic during September and into October on the back of our new retention initiatives such as the enhanced loyalty program, improved VIP offer, and automated reactivation campaigns.”

Party Gaming boasted a base of 7.3 million users in 2009, up 24% from the 5.9 million users it placated to in 2008. The online giant played host to 79,200 average daily players, up from 63,900 in 2008, or 24%. However, its yield per active player day was down significantly in the third quarter of 2009 to $15.40, a slide of 23% year over year and 11% quarter over quarter. The company blamed the dip on “higher bonus costs driven by the acquisition of Cashcade and the costs associated with the new retention initiatives.”

A total of 208,100 new real money sign-ups occurred during Q3 2009 company-wide, a climb of 51% from the 137,600 who registered during Q3 2008. The number of unique active players during the period was 726,300, up 35% from 2008, and the company reported average daily net revenue of $1.2 million, down 5% from 2008, but up 10% over the previous quarter.

All told, PartyPoker boasted 4.6 million active players during the third quarter of 2009, a slide of 2% year over year. The online poker site, which does not accept customers from the United States, hosted 50,400 daily average players, even with 2008 figures, and a $9.70 yield per active player day, down 31% from the $14 recorded last year. PartyPoker saw 120,100 new real money sign-ups during the third quarter, up a colossal 30% from the 92,100 who signed up during Q2 2008. PartyPoker had average daily net revenues of $489,700, a dip of 31% year over year and 9% quarter over quarter.

Company officials explained the poker business unit’s lackluster performance: “Despite the competitive challenges in poker, we continued to sign up large numbers of new players and achieved an absolute increase in player numbers versus the previous quarter despite seasonality. Player yields declined year-on-year due to foreign exchange movements as well as competitive pressures.” On Thursday, it was announced that PartyPoker Ambassador Mike Sexton is the lone member of the Poker Hall of Fame Class of 2009. The World Series of Poker (WSOP) bracelet winner has served as the host of the World Poker Tour (WPT) since it debuted on The Travel Channel in the United States in 2003.

Packer's game spot on, by Terry McCrann - Herald Sun - 14th October 2009

Understanding James Packer and judging his success or failure - present and future - turns entirely on understanding that he has made two big strategic calls.

One was to exit 20th century media - free-to-air TV and magazines. To exit them, self-evidently, in Australia but, for what it's ever worth, the decision applies globally.

It was a decision that developed from the late 1990s, so that he was able, brutally but clinically, to hit the ground running on the death of his father.

The second was to go long 21st century China. At core, seeking to ride exactly the same long wave as BHP Billiton and Rio Tinto, indeed as Australia overall.

But via a very different path. It was - is - of course, his real first (business) love: gaming. And in the only available place, Macau.

Indeed, when you think it through, Packer is really aiming to sell a sophisticated consumer product into the fastest rising disposable incomes on the planet, of some 1.3 billion people. With all the pluses - and very real competitive risks - that entails.

Now, that is 'first love' in a very different way to his late father Kerry or his mentor in this space, the man who in effect built him his money-making Xanadu on the Yarra, Lloyd Williams. For James it is all about the certainty and mind-bogglingly fine detail of the mathematics.

Understand this and you begin to understand where he is going and the dynamics of that journey. And why the US gaming plays that were the focus of the ABC's 45-minute advertisement for Paul Barry's new book were an extremely costly, if instructive, diversion.

Even accounting the $1.5 billion apparently lost cold and extraordinarily rapidly in the US (and Canada and the UK), Packer's combined media and gaming corporate empire has outperformed almost all his relevant peers on his unqualified watch.

As I explained yesterday, the package of value from the old Packer PBL company had increased by $1.20 (down to 97 yesterday) since the death of Kerry on Boxing Day 2005.

This gave shareholders a positive 5.8 per cent TSR (total shareholder return). That's the total over the four years, not per year as I incorrectly wrote in haste yesterday. This compared to a 19.5 per cent negative TSR for Packer's media peer group and an even worse 26.9 per cent negative TSR for the gaming peer group.

The reason was, of course, the spectacular sale of the Nine Network for $5.5 billion - netting him $4.5 billion after the $1 billion he had to reinvest in the network and subsequently lose.

There is just no way to describe this other than as a spectacular coup, spectacularly timed - late in 2006, just as the subprime crisis was starting its slow bubble towards the surface in the US.

Even if you set off the $1.5 billion he would lose in the US against the $4.5 billion, the 'net' was still $3 billion. That's still almost as much as Kerry Stokes got for following him in selling half the Seven Network, just as it was toppling Nine from its long dominance of ratings and advertising dollars.

In short, Packer sold a rapidly depreciating asset beyond the top of the market, exploiting the global financial whiz-kiddery in its dying days! And the deal was even better than it looked.

Why? Because Packer kept the key stakes in Foxtel (25 per cent) and Fox Sports (50 per cent).

Two things are significant about that. It's at least another $1 billion of value - depending how the NBN arm-wrestle plays out, maybe even $2 billion. So his net value out of media was really more like $5.5 billion to $6.5 billion. Secondly, he very deliberately kept what he sees as the 21st century media business. He thinks Foxtel/Fox Sports is the best media business in Australia.

So why did he bend over and sue for peace with the other Kerry; indeed letting him, albeit by proxy, into his media company's boardroom? And did it signify he had a loose affiliation even with Foxtel?

Actually, no. What tended to slip under the radar with the 'mogul peace deal' is that Stokes agreed to 'stand-still' - to not buy any more shares in Packer's Consolidated Media for a year. But Packer did not.

Following the ConsMedia buyback, Stokes' stake goes to 22 per cent, while Packer's will go to a tick over 45 per cent.

Stokes can't buy any more for 12 months. But Packer can and will. He can buy 3 per cent every six months. As the time expires on Stokes' standstill, Packer will move above 50.1 per cent and unchallengable control.

There is no way he will sell out of his remaining - 21st century - media. Unless Stokes or somebody else (it would have to be from another planet) offers him a very silly price. Then the cold-blooded mathematical Packer would kick in.

2 There is no way he is going to 'share' Foxtel with Stokes. He has handcuffed Stokes and in 12 months he could resume hostilities from a position of unchallengable ascendency.

In short, he has moved to 'correct' the mistake he made when he opened the front door by 'selling out' of Nine without bolting the back door to the ConsMedia register. And he's doing, incidentally, the same thing at Crown. He's already started 'creeping' to the same 50.1 per cent.

In short also, the simple fact is that his media plays have been an unqualified success. He has created extraordinary value - in the form of very real (that is, Aussie) dollars.

He has paid for his US mistakes. And he has kept his position in 21st century media, alongside the businessman he most admires and the country's, for the moment, dominant telco.

That leaves judgment on his big 21st century play: China. It is as simplistic to judge that on the basis of what might be happening in Macau this year, as it would be to conclude that the lower prices BHP And Rio were getting this year 'proved' China was a dud for them.

Yes, there might be indigestion in Macau; yes, the Chinese government can play games with visas.

But Macau is very different to Las Vegas. It's the only game in town - until, if, the Chinese allow it in Beijing and Shanghai. And it sits next to 1.3 billion people with rising incomes; against Vegas with 300 million people with falling incomes. (Credit: Herald Sun)

PartyGaming Stock Reaches High, by Greg Tingle - 14th October 2009

PartyGaming stock reached a high this past Tuesday on the London Stock Exchange. The company's stock hit its highest point since May, closing at $278.70.

The high point of the year for PartyGaming stock was reached on 6th May where it went to $283.

PartyGaming pulled out of the United States online gambling market after the Unlawful Internet Gambling Enforcement Act was put in place.

The company did purchase World Poker Tour (WTP Enterprises) via its Peerless Media Ltd arm last August for 12.3 million, and the World Poker Tour website does accept U.S customers. PartyGaming also purchased Cashcade last July for £71.9m in cash.

PartyCasino.com is a major focus of the company and they are currently experiencing substantial growth and revenues with the brand, and are regularly adding Hollywood themed slot games to the portfolio, many of which come from Paramount Pictures and StudioCanal.
